Acceptable Use Policy

The short version. Use Closingbird to run real transactions honestly. Real estate is a prime target for fraud, so we take misuse seriously, especially anything involving wire instructions, signatures or other people's personal information.

This policy is part of our Terms of Service and applies to everyone who uses Closingbird, including your team and anyone you invite.

1. Fraud and deception

Don't use Closingbird to:

  • send, alter or impersonate wire or payment instructions, or otherwise divert escrow, earnest money, commission or closing funds;
  • impersonate a buyer, seller, agent, lender, escrow or title officer, or anyone else;
  • forge, alter or apply a signature without the signer's authority, or tamper with signed documents or audit trails;
  • create or share fake, altered or misleading contracts, disclosures, invoices or other documents; or
  • send phishing messages or links meant to collect passwords or financial details.

If you suspect wire fraud on a transaction, stop, verify instructions by phone using a number you already trust, and tell your escrow or title company immediately.

2. Messaging

  • Send emails and texts only about transactions, to people involved in them who have given you their contact details.
  • No marketing, promotional or bulk messages. Closingbird isn't a marketing tool.
  • Honor opt-outs. Don't text someone who has replied STOP, or try to reach them another way to get around it.
  • No harassment, threats, or hateful or sexually explicit content.
  • Follow carrier rules and the laws that apply to your messages, including the TCPA and CAN-SPAM.

3. Fair housing and discrimination

Don't use Closingbird in a way that violates the Fair Housing Act or other anti-discrimination laws, including screening, steering or treating people differently based on a protected characteristic.

4. Other people's information

  • Only add people and information you have a legitimate reason to handle for a transaction.
  • Don't upload sensitive information you don't need, such as full Social Security numbers or bank account numbers.
  • Share status pages, upload links and intake links only with the people they're meant for.
  • Don't use Closingbird to build contact lists, or to sell or rent personal information.

5. The service itself

Don't:

  • try to reach accounts, workspaces or data that aren't yours, or probe, scan or test Closingbird's security without our written permission;
  • upload malware, or files designed to harm systems or the people who open them;
  • scrape Closingbird, overload it, or use it in a way that degrades it for others;
  • share one login between several people, or work around plan limits such as active transactions, seats or monthly texts;
  • copy, reverse engineer or resell Closingbird, or use it to build a competing product; or
  • use Closingbird for anything illegal, or to store content you don't have the right to use.

6. Enforcement

If we believe this policy has been broken, we may remove content, pause texting or email, suspend users, or close the account, depending on how serious the problem is. Where we reasonably can, we'll tell you first and give you a chance to fix it. We act right away when there's a risk of fraud or harm, or when a carrier, payment provider or law enforcement requires it. We may report suspected crimes, including wire fraud, to the authorities.

7. Reporting abuse

If you received a message through Closingbird that looks fraudulent or unwanted, or you see something that breaks this policy, tell us and include the message if you can. For texts, you can also reply STOP to stop them right away.
